MEDS CANADA COMPREHENSIVE TERMS AND CONDITIONS

1. Introduction and Acceptance of Terms

  1. Meds Canada has created this website, www.medscanada.com (the "Site"), to provide information about our services.
  2. By using the Site or any services provided by Meds Canada, you confirm that you have received, read, understood, and agree to the most current version of these Terms and Conditions.
  3. The most current version of these Terms and Conditions can always be found at www.medscanada.com.

2. Definitions

In these Terms and Conditions:

  • "Meds Canada" refers to MedsCanada.com™ and its affiliates.
  • "Member" means an individual enrolled in the Meds Canada program.
  • "NSP" means Network Service Provider, selected by Meds Canada to provide health services or products for Members.
  • "Prescription" means a direction given by a medical practitioner for dispensing a stated amount of a specified drug.
  • "Prescription Medication" means a drug dispensed pursuant to a Prescription.
  • "Product" means any health service or product sold by an NSP, requiring a Prescription or not.

3. The Meds Canada Program

  1. Any individual may apply for enrollment in the Meds Canada member program (the "Program").
  2. The Program is not an insurance plan and is designed mainly for individuals using maintenance medications for long-term conditions.
  3. Members may purchase health services or products from NSPs using Meds Canada's digital telecommunication services or with assistance from a member service representative (MSR).
  4. Meds Canada will provide all-inclusive pricing for each product, including service charges, commissions, and delivery charges.
  5. Meds Canada is not itself a pharmacy or medical professional. We will take reasonable steps to ensure NSPs are licensed in their jurisdictions but are not responsible for NSP errors or omissions.
  6. Product availability may be limited due to legal restrictions or scarcity.

4. Enrollment and Membership

  1. Enrollment is subject to Meds Canada's criteria, which may change without notice. Some applicants may not qualify for membership.
  2. Eligible members will receive a "Meds Canada MEMBER ID". Possession of an ID does not guarantee membership.
  3. Participation in the Program is voluntary and at the Member's own risk.
  4. Meds Canada may terminate the Program or individual participation at any time without notice or cause.
  5. Members must comply with these Terms and Conditions to remain eligible for the Program.
  6. Membership does not constitute a partnership, joint venture, or principal agency relationship with Meds Canada.

5. Use of the Site

  1. Your use of the Site is governed by these Terms and Conditions and the Meds Canada Privacy Notice.
  2. You may view, download, or print materials from the Site for personal, non-commercial use, provided you retain all copyright and proprietary notices.
  3. Any other use of the Site's content is prohibited without our express written permission.

6. Power of Attorney

Members authorize Meds Canada and NSPs as agents and attorneys for limited purposes related to completing product sales, including:

  1. Appointing third-party delivery services.
  2. Facilitating prescription renewals or co-signs by physicians licensed in the NSP's jurisdiction.

7. Medication Orders and Use

  1. Members must be of legal age to make medical decisions and use prescribed medications as directed.
  2. Members will be the only person using the Prescription Medication ordered and will use them as prescribed.
  3. Orders are limited to a 3-month supply of Prescription Medication.
  4. Prescription Medication orders are non-refundable and non-exchangeable.
  5. Members must obtain prescriptions from licensed physicians in their jurisdiction of residence.
  6. Members must disclose all relevant medical information and notify Meds Canada of any changes to their condition.
  7. Members should contact their primary physician if experiencing unexpected side effects.

8. Information Handling

  1. The collection, retention, disclosure, and use of personal health information is governed by the Meds Canada Privacy Notice.
  2. Members authorize Meds Canada to collect and share personal health information with NSPs and physicians as necessary to facilitate prescriptions.

9. Dispensing and Delivery

  1. Valid prescriptions are required for fulfillment, and may need to be re-written or co-signed by a licensed physician in the NSP's jurisdiction.
  2. When possible, Prescription Medication will be in original manufacturer's packaging.
  3. Generic substitutions may be made unless otherwise indicated.
  4. Controlled substances are only available where permitted by law.
  5. Sales occur in the NSP's jurisdiction, and Members are responsible for personal importation.
  6. Meds Canada guarantees order arrival within 30 days upon receipt of all necessary documentation. Average shipping time is typically 5-10 days.
  7. If an order is not received within 30 days, Meds Canada will replace it at no charge.

10. Intellectual Property

  1. All trademarks, logos, and brand names displayed on the Site are the property of their respective owners.
  2. Their use on our site is for identification purposes only and does not imply endorsement.

11. Disclaimer of Warranties

  1. THE SITE AND ITS CONTENT, FUNCTIONS, MATERIALS, AND INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
  2. Meds Canada does not warrant that the Site or its services will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

  1. Members release Meds Canada, NSPs, and their affiliates from liability except where Meds Canada is directly liable under Canadian law.
  2. Meds Canada's liability, where applicable, is limited to actual losses recoverable under Canadian law, excluding punitive or exemplary damages.

13. Dispute Resolution

  1. Agreements are deemed made in Canada and governed by Canadian law.
  2. Disputes shall be resolved in Canadian courts, or through binding arbitration for U.S. consumers using the American Arbitration Association.
  3. No action or claim may be brought more than a year after receiving the ordered Product(s).

14. Changes to Terms and Site

  1. Meds Canada reserves the right to make reasonable changes to these Terms and Conditions from time to time.
  2. Any changes will be posted on our website. Continued use of our services after such changes constitutes acceptance of the updated Terms and Conditions.
  3. Meds Canada reserves the right to alter, suspend, or discontinue any aspect of the Site or its services at our discretion.

15. Miscellaneous

  1. If any provision of these Terms and Conditions is declared unlawful, void, or unenforceable, the remaining provisions shall remain in effect.
  2. These Terms and Conditions constitute the entire agreement between Meds Canada and the Member, superseding any prior agreements or communications.

BY USING MEDS CANADA'S SERVICES, I CONFIRM THAT I HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS AND CONDITIONS, AND THAT MY REPRESENTATIONS ARE TRUE AND CORRECT. I AGREE THAT THESE TERMS AND CONDITIONS ARE BINDING ON ME AND MY HEIRS, EXECUTORS, LEGAL PERSONAL REPRESENTATIVES, AND ASSIGNS.
